These Terms of Service ("Terms") govern your use of kourtz.co and any purchase from Kourtz LLP ("Kourtz", "we", "us"). By accessing the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or accessing the Site under the supervision of a parent or guardian, and able to enter into a binding contract.

2. Products and pricing

We take care to describe our products accurately, but colours, finishes, and specifications may vary slightly, and product images may differ from the actual item. All prices are listed in Indian Rupees (₹) and are the final amount payable. We may change prices, products, or specifications at any time without notice.

3. Orders

Your order is an offer to purchase. We may accept or decline any order, and may cancel an order (with a full refund) in cases such as pricing errors, suspected fraud, or stock unavailability. An order is confirmed once you receive our confirmation.

4. Payment

We accept UPI, cards, netbanking, and cash on delivery. Online payments are handled by third-party payment gateways; by paying, you agree to their terms in addition to ours.

5. Shipping, exchanges, and warranty

Delivery, exchanges, and warranty are governed by our Shipping Policy, Returns & Exchange Policy, and Warranty, which form part of these Terms.

6. Intellectual property

All content on the Site — including the Kourtz name and logo, text, images, and designs — is owned by or licensed to Kourtz LLP and may not be used without our written permission.

7. Acceptable use

You agree not to use the Site unlawfully, to infringe our or others' rights, to introduce malicious code, or to attempt to disrupt or gain unauthorised access to the Site.

8. Disclaimers and limitation of liability

The Site and products are provided on an "as is" and "as available" basis. Pickleball is a physical activity; you are responsible for using our products safely and within their intended use. To the maximum extent permitted by law, Kourtz LLP's total liability arising from a product or order is limited to the amount you paid for that order. Nothing in these Terms limits rights you have under the Consumer Protection Act, 2019 that cannot be excluded by law.

9. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.
